Introduction

These conditions govern sales between La Sabounnerie and its customers.

Acceptance

By checking the box "I declare that I have read the applicable general terms and conditions of sale and have accepted them without restriction" and validated the payment, the customer confirms that they have read and accept all of the general terms and conditions of sale to the exclusion of any other general terms and conditions, unless otherwise agreed by the seller. Quotes, purchase orders and invoices are covered by the general terms and conditions of sale and imply full acceptance by the customer.

Orders

An order confirmation is sent by email to the email address provided by the customer. La Sabounnerie reserves the right to cancel any order from a customer in the event of a dispute regarding the payment of a previous order.

When ordering, the information provided involves the customer. Orders are sent only to the postal address provided by the latter. In the event of an error concerning the recipient's contact information, the seller is not responsible for the impossibility of delivering the goods.

Delivery

After confirmation of the order, La Sabounnerie undertakes to deliver to its carrier all the references ordered by the buyer within a maximum period of 30 days (from the day after receipt of the order).

Products purchased on La Sabounnerie are delivered to mainland France, EU countries and outside the EU, by the postal services Colissimo, Chronopost and Mondial Relay.

The times indicated are usual average times and correspond to processing and delivery times. In the case of items deliverable on different dates, given their availability, the delivery time is based on the longest time; La Sabounnerie reserves the right to split deliveries, only the products shipped are then debited. Participation in processing and shipping costs will only be invoiced for a single shipment.

La Sabounnerie cannot be held responsible for the consequences due to a delay in delivery.

Any order not shipped within 30 days of the order will be cancelled unless otherwise stipulated and announced in the sales offer.

In case of pre-order, the thirty-day period starts from the official release date of the pre-ordered product.

The customer must notify the carrier and La Sabounnerie of any reservations about the delivered product (damaged package, already opened, etc.) within three days of receiving the product. In the case of a technical product, the customer will take particular care to check that the delivered device is working properly and to read the instructions for use provided.

In the event of apparent defects, the customer has the right to return the item under the conditions set out in this document.

In addition, for deliveries outside mainland France, the customer agrees to pay all taxes due on the importation of products, customs duties, value added tax, and all other taxes due under the laws of the country where the order is received.

In the event of a pre-order, La Sabounnerie undertakes to deliver to its carrier all the references ordered by the buyer within a maximum period of 15 working days after the official release date of the pre-ordered product.

Withdrawal

The right of withdrawal allows the customer to cancel the order placed online within 14 days, except for sale items. The period starts from the day after receipt of the order. Returns are free, simply follow the return terms on the following page: return and exchange (hyperlink).

Returned products must be new in their original packaging, with all possible related accessories, as well as documentation. Otherwise, if the returned items are damaged or incomplete, they will not be taken back. In the event of abnormal or abusive returns, La Sabounnerie reserves the right to refuse a subsequent order.

La Sabounnerie has 14 days to reimburse the full amount paid and this will be done using the same payment method as when purchasing.

No exchange is possible; if the customer wishes to exchange, a return request must be made to our customer service in order to return the unwanted products to us and then recommend the desired product on our site. However, some products are not subject to the right of withdrawal and therefore cannot be refunded. This is particularly the case for personalized products, all products related to the medical field (single wise, care, first aid, medical equipment, disinfection and sterilization, hygiene), single-use and disposable products, liquid products.

Price

The price is expressed in Euros. The price is indicated excluding tax (HT) and with all taxes included (TTC). The price of the product indicated in the catalog corresponds only to the price of the product, without the cost of transport. The final price charged to the customer is the price indicated during the online payment. For France and the countries of the European Union, the final price includes VAT and all taxes.

The discount code must be entered in the box provided for this purpose in the shopping cart before the payment step. Discount codes cannot be combined. Once the order is paid for and validated, it is not possible to use the discount code for this order afterwards.

La Sabounnerie reserves the right to modify prices at any time. However, for any accepted order, La Sabounnerie guarantees the prices in effect on the date of confirmation of the order by La Sabounnerie.

PAYMENT

The price of the products is payable in cash on the day of the actual order and payment is made by credit card bearing the CB logo, via Paypal. You can also pay by bank transfer by following the instructions given to you throughout the purchase process. Please note, however, when paying by bank transfer, due to processing times and as indicated on our site, the delivery time of your order is therefore recalculated from the validation of the order by our accounting department.

The order validated by the customer will only be considered effective when the relevant bank payment centers have given their agreement. In the event of refusal by said centers, the order will be automatically canceled and the customer notified by email. Furthermore, La Sabounnerie reserves the right to refuse any order from a customer with whom there is a dispute.

We use Shopify Payments for all online transactions.

Intellectual property

The site is the property of the company La Sabounnerie in its entirety, as well as all related rights.

The photos and descriptions are not contractual, they are the property of the distributed brands.

All texts, works, illustrations and images reproduced on La Sabounnerie are reserved under copyright and intellectual property law and for the entire world. As such and in accordance with the provisions of the Intellectual Property Code, only use for private use is authorized, subject to different, or even more restrictive, provisions of the Intellectual Property Code.

Any reproduction, in whole or in part, of the site is systematically subject to authorization from the company La Sabounnerie.

Responsibility

The products offered comply with current French legislation and the standards applicable in France. La Sabounnerie cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is the customer's responsibility to check with the local authorities the possibilities of importing or using the products.

The liability of La Sabounnerie is systematically limited to the value of the product in question, value on its date of sale and this without the possibility of recourse against the brand or the company producing the product.

All orders placed with La Sabounnerie are intended for the personal use of customers. Customers or recipients of the products are prohibited from any partial or total resale of the products. La Sabounnerie is therefore released from any legal liability if the payment of taxes is not made by the customer.

In any event, the customer benefits from the legal guarantee of eviction and hidden defects (art. 1625 et seq. of the Civil Code); on condition that the buyer proves the hidden defect. The seller must legally repair all the consequences (art. 1641 et seq. of the Civil Code). If the buyer goes to court, he must do so within a "short period" from the discovery of the hidden defect (art. 1648 of the Civil Code).

Personal information

The provision of personal information collected for the purposes of distance selling is mandatory, as this information is essential for processing and delivering orders, drawing up invoices and warranty contracts. Failure to provide this information will result in the order not being validated.

In accordance with the "Informatique et Libertés" law, the processing of personal information relating to customers has been declared to the National Commission for Information Technology and Civil Liberties (CNIL). The customer has (article 34 of the law of January 6, 1978) a right of access, modification, rectification and deletion of data concerning him, which he can exercise with La Sabounnerie.

La Sabounnerie undertakes not to disclose to third parties the information communicated by the customer. This information is confidential. It will only be used to process the customer's order and to strengthen and personalize the communication of products reserved for La Sabounnerie customers, in particular through La Sabounnerie newsletters to which the customer has subscribed as well as in the context of personalizing the site according to your interests.

Our site is also designed to best meet the needs of our customers and it is for this purpose that we use cookies. The latter are intended to signal the customer's passage on our site and are only used by La Sabounnerie for the purpose of improving the personalized service intended for the customer.

Disputes

This contract is subject to French law. La Sabounnerie cannot be held responsible for damages of any kind, whether material, immaterial or physical, which could result from a malfunction or improper use of the products sold. The same applies to any modifications to the products resulting from the manufacturers. The liability of La Sabounnerie will, in any event, be limited to the amount of the order and cannot be called into question for simple errors or omissions which could have remained despite all the precautions taken in the presentation of the products.

In the event of difficulties in the application of this contract, the customer has the possibility, before any legal action, to seek an amicable solution, in particular with the help of a professional association in the sector, a consumer association or any other advisor of his choice. It is recalled that the search for an amicable solution does not interrupt the "short period" of the legal guarantee, nor the duration of the contractual guarantee. It is recalled that as a general rule and subject to the assessment of the Courts, compliance with the provisions of this contract relating to the contractual guarantee assumes that the buyer honors his financial commitments to the seller.

Complaints or disputes will always be received with attentive kindness, good faith always being presumed in the person who takes the trouble to explain these situations. In the event of a dispute, the customer will contact the company as a priority to obtain an amicable solution.

Failing this, the Commercial Court of PARIS shall have sole jurisdiction, regardless of the place of delivery and the method of payment accepted.
